Terms of Service (TOS)

Thank you for choosing to use ChatrrApp powered by TeleCAIN LLC.  Please read these terms of service carefully before using our App. By downloading and using our App, you agree to be bound by these terms of service.

Earning Rewards

Our App allows you to earn cash value rewards for every call you make as long as a sponsored message is available to be played. You will receive your rewards after the call is completed. If no sponsored message is available to be played, the call will continue to process but you may not earn rewards for that call.

Use of Rewards

Your ChatrrApp rewards can be used to pay for certain in-app purchases or be donated to verified charities(coming soon) listed in ChatrrApp or any other options we provide in the CashOut section of the app. 

User Conduct

You agree to use ChatrrApp only for lawful purposes and in a manner that does not infringe the rights of any third party, or cause annoyance, inconvenience, or harm to anyone else. You also agree not to use our App to upload or distribute any content that is unlawful, harmful, offensive, or otherwise objectionable.

You agree not to manipulate, defraud, or otherwise misuse ChatrrApp for the intention of gaining rewards outside of the genuine nature that rewards are meant to be earned.

Any suspicion of such activities will immediately cause suspension of accounts until a full review can be done.

Liability

We make every effort to ensure that our App is error-free and free from viruses, but we do not guarantee that our App will be uninterrupted, error-free, or virus-free. We will not be liable for any loss or damage suffered by you as a result of your use of our App, except for any liability that cannot be excluded by law.

Indemnity

You agree to indemnify and hold us harmless from and against any claims, actions, proceedings, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of our App, or any breach by you of these terms of service.

Intellectual Property

All intellectual property rights in our App and the content provided through our App belong to us or our licensors. You are not permitted to use any of our intellectual property without our prior written consent. ChatrrApp is committed to helping people and organizations protect their intellectual property rights. Our users agree to our Terms of Service ("Terms") by installing, accessing, or using our apps, services, features, software, or website (together, "Services"). Our Terms do not allow our users to violate someone else's intellectual property rights when using our Services, including their copyrights and trademarks.

Amendments

We reserve the right to amend these terms of service at any time without notice. Your continued use of our App following any amendment to these terms of service will constitute your acceptance of the amended terms.

Governing Law

These terms of service are governed by the laws of the jurisdiction where the App is provided. Any dispute arising from or in connection with these terms of service will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Fees And Taxes.

You are responsible for all carrier data plans, Internet fees, and other fees and taxes associated with your use of our Services but remember you can use your earned rewards to purchase data top ups from your carrier data plans where available.

NO ACCESS TO EMERGENCY SERVICES

There are important differences between our Services and your mobile phone and a fixed-line telephone and SMS services. Our Services do not provide access to emergency services or emergency services providers, including the police, fire departments, or hospitals, or otherwise connect to public safety answering points. You should ensure you can contact your relevant emergency services providers through a mobile phone, a fixed-line telephone, or other service.

Privacy Policy And User Data

ChatrrApp cares about your privacy. Our Privacy Policy outlined here describes our data (including message) practices, including the types of information we receive and collect from you, how we use and share this information, and your rights in relation to the processing of information about you. The types of information we receive and collect depend on how you use our Services. We require certain Account Information in accordance with our Terms to deliver our Services and without this we will not be able to provide our Services to you. For example, you must provide your mobile phone number to create an account to use our Services.

Information You Provide

Your Account Information - You must provide your mobile phone number and may ask for a profile name of your choice to create a ChatrrApp account. If you don’t provide us with this information, you will not be able to create an account to use our Services. You may be able to add other optional information to your account, such as a profile picture, and "about" information at your discretion.

User Content - Your Messages, Media within Messages, and Calls: We offer end-to-end encryption for our Services. End-to-end encryption means that your calls, messages, media within messages including content like images, audio, video, documents and files are encrypted to protect against third parties from seeing that content.

Typically your messages are stored on your device(s) and not on our servers. We temporarily store your messages in encrypted form while they are being delivered. Once your messages are delivered, they are deleted from our servers.

Account Access Information -  When you sign up or log-in to our Service, we verify your phone number by sending you a code via SMS and using a 2FA system for the rewards platform.

Automatically Collected Information

Usage Information - We collect information about your usage of our Services. This includes collecting information about your activity (including how you use our Services), how you interact with others using our Services (including when you search for and interact with a business), and the time, frequency, and duration of your activities. This also includes information about the features you use like our messaging (and integrated applications), calling, and any other future  features; whether you are online; timestamps related to your use such as when you last used our Services (your "last seen") and the times you send and receive calls and messages; and when you last updated your "about" information.

Log and Troubleshooting Information - We collect information about how our Services are performing when you use them, like service related diagnostic and performance information. This information includes log files, timestamps, diagnostic or crash data, website performance logs and error messages or reports.

Device And Connection Information - We collect device and connection-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, battery level, signal strength, app version, browser information, mobile network, connection information including whether you are using wifi or cellular data, mobile operator or internet service provider (ISP), language and time zone, IP address, device operations information and identifiers.

General Location Information - Even if you do not choose to use our precise location-related features we use IP addresses and other information like phone number area codes, to estimate your general location (e.g., country), this help maximizes your earning potential and to increase the most relevant ads to be heard.

Cookies - We collect information using cookies to operate and provide our web-based Services and website, this again is to help maximizes your earning potential and to increase the most relevant ads to be heard.

Authentication Information - To verify and grant appropriate authorizations as you use the Services (such as when you choose to use encrypted backups and create your unique password), we create and store authentication codes which are a security measure to ensure only you are accessing your account. Authentication Information also includes your public encryption keys that our end-to-end encryption protocol uses. Messages are encrypted before they reach our servers which means that we cannot see them.

Licenses

Your Rights

ChatrrApp does not claim ownership of the information that you submit for your ChatrrApp account or through our Services. You must have the necessary rights to such information that you submit for your ChatrrApp account or through our Services and the right to grant the rights and licenses in our Terms.

ChatrrApp's Rights

We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks (or any similar marks), domains, logos, trade dress, trade secrets, patents, or other intellectual property rights unless you have our express permission and except in accordance with our Brand Guidelines. You may use the trademarks of our affiliate companies only with their permission, including as authorized in any published brand guidelines.

Your License To ChatrrApp

In order to operate and provide our Services, you grant ChatrrApp a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the information (including the content) that you upload, submit, store, send, or receive on or through our Services. The rights you grant in this license are for the limited purpose of operating and providing our Services (such as to allow us to display your profile picture and status message, transmit your messages.

ChatrrApp's License To You

We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.

Termination

 Although we hope you remain a ChatrrApp user, you can terminate your relationship with ChatrrApp anytime for any reason by deleting your account.  In accordance with this "Termination" section, we may also modify, suspend, or terminate your access to or use of our services anytime for suspicious or unlawful conduct, including for fraud, or if we reasonably believe you violate our terms or create harm, risk, or possible legal exposure for us, our users, or others. We may also disable or delete your account if it does not become active after account registration or if it remains inactive for an extended period of time. If you delete your account or we delete or disable it, these Terms will end as an agreement between you and us, but the following provisions will survive any termination of your relationship with ChatrrApp: "Licenses," "Disclaimers And Release," "Limitation Of Liability," "Dispute Resolution," "Availability And Termination Of Our Services," and "Other.” If you believe your account's termination or suspension was in error, please email us at support@chatrrapp.com.

In the event that a user seeks to delete their account on ChatrrApp, they may initiate this process directly from within the application. Prior to proceeding, the user will be required to confirm their intent to perform this action, with the understanding that any accrued rewards will be permanently forfeited. Following initiation, the account deletion process can take up to 48 hours, during which all personally identifiable information associated with the user will be meticulously expunged from our databases. It is important to note that account reactivation is not supported; should a user wish to utilize our services again, they will need to undergo the registration process as a fresh/new subscriber.
